This Site/Application/Services is operated by Shweta Enterprises(“Khatola”). These terms and conditions (“User Terms”) govern your use of the Site, whether accessed via computer or mobile device, as well as all information and services provided through it.

This electronic record is created in accordance with the Information Technology Act, 2000, and does not require physical or digital signatures.

By clicking “I ACCEPT” or using Khatola’s services, you agree to these User Terms. Please read them carefully. If you do not agree, do not use the Site or its services. Your acceptance forms a binding agreement with Khatola regarding your use of the Site.

Khatola reserves the right to terminate these Terms or any Services at any time for any reason. Supplemental terms may apply to specific Services and will be disclosed accordingly.

User Terms Acceptance:
By accepting these User Terms, you also agree to our Privacy Policy and consent to receive promotional emails and SMS alerts from Khatola. Note that these User Terms do not apply to corporate entities governed by Khatola Corporate Terms, but authorized users taking “Khatola Corporate Rides” will still be subject to these terms.

• Application: The mobile app “Khatola Cabs,” updated periodically.
• Convenience Fee/Access Fee: Fees for value-added services provided by Khatola.
• Cancellation Fee: Fee for canceling a Ride, as detailed in Clause 7.
• City of Operation: The city where transportation services are rendered.
• Customer/You: An individual with an Account on the Application.
• Driver: Individuals authorized to provide transportation services using registered Vehicles.
• E-Wallet: A pre-paid instrument for making payments.
• Fare: The amount payable for a Ride, reflecting distance and time.
• Force Majeure Event: Events beyond Khatola’s control.
• Khatola: Shweta Enterprises.
• Registration Data: Information required for account registration.
• Ride: The travel in a Vehicle facilitated by Khatola.
• Service(s): Services provided through the Application or via telephone.
• Site: The Application and the website https://www.khatolacabs.com/.
• Substitute Vehicle: A replacement vehicle in case of a breakdown.
• Peak Charge: Additional fees during high demand.
• Total Ride Fee: Fees based on various parameters (distance, time, etc.).
• T&Cs/User Terms: These terms and conditions.
• TPSP: Third-party service provider.
• Vehicle: A motor cab as defined under the Motor Vehicles Act, 1988.

2. Eligibility

You are eligible to use the Services if you meet the following criteria:

• You are at least 18 years old.
• You are legally capable of entering into a contract under applicable laws.

3. Registration and Account

You can register on the Site only after providing your Registration Data.

Ensure that your Registration Data is accurate and up-to-date. Khatola is not liable for any issues arising from false or outdated information.

4. Services

The Services are a technology platform connecting users with independent third-party transportation and logistics providers. Khatola does not provide these services directly.

By using the Application, you agree to:

• Use the Service for personal use only, not for resale.
• Not use someone else's account without authorization.
• Not engage in unlawful activities.
• Avoid harming the Service or network.
• Comply with all applicable laws, including the Information Technology Act, 2000.

5. Confirmation of Booking

Khatola will confirm or decline your booking based on vehicle availability, notifying you via the app, SMS, or email. If confirmed, check the booking details and inform us immediately of any inaccuracies.

6. Payment

Khatola will provide an estimated Total Ride Fee at the start of each ride, but this may change. You will pay the actual fee at the end of the ride.

7. Cancellation Policy

Khatola will display the Cancellation Fee on the Application. You may cancel anytime, subject to this fee, which is detailed on our website. You will be notified of the fee before cancellation, and it will be added to the Total Ride Fee for your next ride or must be settled beforehand.

8. User Violation of User Terms

You shall not smoke, drink, or carry any contraband substances in the Vehicles or misbehave with the Driver or distract the Driver. In such events, you shall be liable to pay a fine, and your ride may be terminated. Failure to pay may result in your account being blacklisted.

9. Customer Relationship Management

All issues, opinions, suggestions, questions, and feedback while availing our Services can be communicated to us via several modes such as self-serve app or website or email.

10. Emergency Services to Customer

By accepting these User Terms and pressing the SOS button on the Khatola App, you consent to Khatola providing assistance during emergencies as per Khatola’s internal policies.
